When the police first discovered the scene they assumed, from appearances, that Robin Bain had committed suicide, so they conducted tests to try to establish this. Karam expresses anger and confusion that the scene examiners first concluded that it was suicide and then changed their tune several days later.

Karam claims that in the first trial when the Judge asked the jury the question: Who did it, Robin or David? it created a flawed premise under which to conduct a trial.  The retrial was conducted under the same premise, so if the first trial was invalid for that reason then so too must be the retrial.
